Facts

During the 1994 genocide against Tutsis in Rwanda, Agathe Habyarimana is suspected of having financed the Radio-Télévision Libre des Mille Collines, which broadcast anti-Tutsi hate messages, of giving her consent to acts of terror carried out by the presidential guard and of ordering the massacre of employees of an orphanage.

Procedure

In 2008, the Collectif des parties civiles pour le Rwanda (CPCR) filed a complaint against Agathe Habyarimana for her alleged role in the 1994 genocide in Rwanda. The International Federation for Human Rights (FIDH) joined the case as civil party.

In 2016, Agathe Habyarimana was placed under the intermediary status of assisted witness (témoin assisté).

In January 2022, the investigating judges closed the investigation.

In August 2022, the prosecutor requested the reopening of the investigation and several investigating acts.

In September 2024, the prosecutor requested that Agathe Habyarimana be charged while under investigation (mise en examen). This request was rejected by the judges.

In August 2025, the investigating judges closed the investigation and dismissed the charges against Agathe Habyarimana.

The civil parties appealed this decision.

On 6 May 2026, the French Court of Appeal ordered the re-opening of the investigation against Agathe Habyarimana.
